THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.22421 of 2026 ORDER: 1) The present Writ Petition filed questioning the action of Respondents in not implementing the directions given by the Government vide G.O.Ms.No. 67, dated 11.04.2025, granting notional seniority to the Petitioner in the post of Reserve Inspector.
2) The Petitioner was appointed as Reserve Sub-Inspector (Armed Reserve) within Eluru Range in the year 2003. The Petitioner relinquished promotion to the post of Reserve Inspector during the panel year 2009- 2010, 2010-2011 and 2011-2012, as the Petitioner was expecting appointment-by-transfer to the post of Sub-Inspector (Civil). Thereafter, the Petitioner was not considered for appointment-by-transfer to the post of Sub Inspector (Civil) and, as such, the Petitioner expressed his willingness for promotion to the Reserve Inspector and requested for promotion during the panel year 2013-2014. The said request was not considered in view of the ban imposed by the Government upto the year
2016. 3) In the year 2016-2017, the Petitioner’s promotion to Reserve Inspector was deferred on account of punishment imposed on him 01.09.2015 in a disciplinary enquiry. During that panel year, the juniors of the Petitioner were promoted. Thereafter, the Petitioner filed Revision

before the Government and the punishment was set-aside by the Government on 06.03.2017 vide G.O.Rt.No.155 and the Petitioner was promoted during the panel year 2017-2018. As the Petitioner’s promotion to the post, for panel year 2016-2017, was denied on account of punishment imposed, the Petitioner after exoneration submitted representations for promotion, assigning notional seniority, on par with the juniors who were promoted in the panel year 2016-2017. Thereafter, taking note of the representation of the Petitioner, the Government issued G.O.Ms.No.67, dated 11.04.2025, assigning notional seniority to the Petitioner on par with his juniors, for the panel year 2016-2017. 4) Presently, the grievance of the Petitioner is that, benefit of G.O.Ms.No.67, dated 11.04.2025, was not effected for the seniority list and the Petitioner continues to be shown as promoted in the panel year 2017-2018. Further, promotions to the post of Deputy Superintendent of Police are likely to be undertaken by the Respondents. Therefore, the Petitioner gave a representation to Respondent No.2 to implement the said G.O. and fix notional seniority to the Petitioner on par with his juniors who were promoted during the panel year 2016-2017. As the representation is not considered, the present Writ Petition is filed. 5) Learned Assistant Government Pleader for Services-I submits that the representation of the Petitioner will be examined and an appropriate decision will be communicated to the Petitioner. 6

7) Considering the submissions made, the Writ Petition is disposed of with the following directions: i) The Respondent No. 2 shall implement G.O.Ms.No.67, Home (Services-I) Department, dated 11.04.2025, as expeditiously as possible and also consider the case of the Petitioner for appointment to the post of Deputy Superintendent of Police. ii) There shall be no order as to costs.
