03/19.01.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Rajganj P.S. Case No.73 of 2012, registered for the offence under Sections 467, 468, 471, 473, 419, 420, 414 of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate, 1st Class, Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner happened to be owner of Omkar Fuels where the coal has been loaded. He further submits that the allegations are there of changing number of the truck and nature of the coal. He then submits that the petitioner was not knowing the fact that the number of truck and nature of coal has been changed. He next submits that the owner of the said vehicle has been granted anticipatory bail by a Coordinate Bench of this Court in A.B.A. No.7043 of
2020.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner happened to be owner of Omkar Fuels.
5. Considering that the allegation is there of changing number of truck and nature of coal and the petitioner happened to be owner of Omkar Fuels

where the coal has been loaded and the owner of the said truck has been granted anticipatory bail in the aforesaid A.B.A. and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with Rajganj P.S. Case No.73 of 2012, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
