THE STATION HOUSE OFFICER, NANDYAL I TOWN POLICE STATION, NANDYAL DISTRICT, ANDHRA PRADESH. ...RESPONDENT/COMPLAINANT(S): Counsel for the Petitioner/accused: N PULLARAO Counsel for the Respondent/complainant(S): PUBLIC PROSECUTOR 2 Dr.YLR,J Crl.P.No.6608 of 2026 Dated 14.08.2026 The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused on bail in Crime No.53 of 2026 of Nandyal I Town Police Station, Nandyal District, registered against the Petitioner/Accused herein for the offence punishable under Section 303(2) of the Bharatiya Nyaya Sanhitha, 2023 (for brevity ‘the BNS’). 2. Mr.N.Pulla Rao, learned counsel for the petitioner, submits that the petitioner is innocent and that he has not committed any offence. He has been falsely implicated in this case. He is a law-abiding citizen. Since the charge sheet has been filed in this case, the petitioner would not be in a position to tamper with the evidence. The petitioner would abide by any conditions that this Court deems fit to impose while enlarging him on bail. The petitioner has been in judicial custody for the past 82 days. Hence, it is urged to enlarge the petitioner on bail. 3. Per contra, Mr.A.Sai Rohith, the learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner and submitted that, though the charge sheet has already been filed, the accusations against the petitioner are well founded. Hence, he prayed that the Criminal Petition be dismissed 3 Dr.YLR,J Crl.P.No.6608 of 2026 Dated 14.08.2026 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, the petitioner was arrested on 24.05.2026 and has been in judicial custody for the past 82 days only. Out of the sale proceeds of Rs.55,000/-, an amount of Rs.40,000/- was recovered from the possession of the petitioner, who is the sole accused in this case. After thorough investigation, the charge sheet has been filed. The accusation against the petitioner is well-founded. There are altogether 32 cases registered against the petitioner. 6. Having regard to the entire facts and circumstances of the case, in view of the specific accusations being well-founded, there are no merits in granting bail to the petitioner/Accused at this juncture. Accordingly, this Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
