CMP(M) No.766 of 2026 Keeping in view the fact that the case file was misplaced in the office of the EE Jubbal therefore, the same remained un-dealt, due to which the delay has taken place, the legal issue is pending consideration before this Court in LPA No.337 of 2025, titled State of Himachal Pradesh and another Vs. Punit Bashtu and also taking into consideration the judgment of the Apex Court in Sheo Raj Singh (deceased) through LRs and others Vs. Union of India & another, (2023) 10 SCC 531, the delay of 119 days in filing the appeal is condoned. 2. The application stands disposed off accordingly. 3. Appeal be registered. LPA No. of 2026 4. Inter alia contends that the specific stand of the appellants-State is that the land was used for the road, namely, Thana via Turan in the year 1990 manually and the work was completed in the year 2001 and this fact was also noticed by the learned Single Judge. It is submitted that no steps were taken by the landowner or predecessor- in-interest to initiate acquisition proceedings and the road had been constructed as per the demand of the people living in the area. Only on account of some others having approached this Court and having been granted the relief in the year 2018 (Anneuxre P-2), the writ petition came to be filed in the year 2023 by giving a reference of acquisition which had taken place in the year 2005 and concealing the fact that the acquisition was done much earlier. 5. It is submitted that the said issue is subject matter of consideration before this Court in LPA No.337 of 2025, titled State of Himachal Pradesh and another Vs. Punit Bashtu. 6. Issue notice to the respondent, on taking steps within three days, returnable for 28.05.2026. 7. To be heard alongwith LPA No.337 of 2025, titled State of Himachal Pradesh and another Vs. Punit Bashtu a/w connected matters on 28.05.2026. CMPST No.26505 of 2026 8. Execution and operation of the impugned judgment dated 28.10.2024, passed in CWP No.3069 of 2023, titled Pritam Singh Chauhan and others Vs.
