The petitioner is in custody for about a year. Five witnesses have already been examined and as such the petitioner may be released on bail. Learned advocate appearing for the State opposes the prayer for bail and submits that recovery is of commercial quantity. On an assessment of every fact, I find that trial is in progress and the same is progressing very smoothly and already five witnesses have been examined. At this stage, appreciation of correctness of the evidence may prejudice either of the sides and as such this Court refrains from commenting on the deposition of the witnesses concerned. However, rigors under section 37 of the NDPS Act is attracted and as such the prayer for bail of the petitioner in CRM (NDPS) 367 of 2026 is rejected.
