Chatterjee, A.P.P. ------ 05/ 04.05.2026 Heard learned counsel for the petitioners and learned A.P.P for the State. 2. The petitioners are apprehending their arrest in connection with Chowka P.S. Case No. 02 of 2026, registered for the offence under Sections 303(2), 317(2), 61(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 21 of the Mines and Minerals (Development and Regulation) Act, 1957 and Rule 13 of the Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules, 2017 pending in the court of learned S.D.J.M., Chandil. 3. Learned counsel appearing for the petitioners submits that the petitioner No. 1 is the owner and petitioner No. 2 is the driver of the trailer, on which, iron ore was being carried. She next submits that at the time of checking the documents, valid challan as well as e-way bill of the consignment have been produced, in spite of that the vehicle has been seized and to buttress her argument, she draws the attention of [2026:JHHC:13133] -2- the court to Annexure-3 series of the petition, which are the e-way bill and Checkgate copy in Form-G-1 and also the transit permit. She also submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of carrying the iron ore in absence of proper paper. 5. Annexure-3 series are the documents, which clearly suggests that these are the e-way bill, Checkgate copy in Form-G-1 and also the transit permit and further the petitioners are the owner and driver respectively and they are having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition. 5. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners, above named. 6. Accordingly, the petitioners, named above, are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Chandil, in connection with Chowka P.S.
