Also heard the learned Additional Public Prosecutor. Page No.# 2/3 This is an application filed under Section 483 of BNSS, 2023 for grant of regular bail. On 02.06.2026, one Sri Jugal Kalita lodged an FIR before the Officer-in- Charge, Azara Police Station, alleging inter-alia the informant's son, namely Nirban Kalita, aged about 20 years, who is an employee at Snowman Company situated at Azara, Mirzapur. It is alleged that accused No. 2 informed the victim that one of his co-workers, namely accused No. 1, had entered a bathroom with a girl and requested the victim (Nirban Kalita) to record a video of the same. It is further alleged that on the date of the occurrence, at about 6:30 P.M., the accused persons, by deceitful means, called the victim to Dharapur Majuli and, along with approximately ten(10) other persons, jointly and repeatedly assaulted him with the intention to kill him. It is further alleged that, as a consequence of the said assault, the victim sustained grievous injuries on various parts of his body. It is also alleged that local people witnessed the incident and rescued the victim from the clutches of the accused persons in a near-dead condition and immediately shifted him to Garal Hospital. Thereafter, considering the seriousness of the injuries allegedly sustained by the victim, the attending doctor referred him to Gauhati Medical College and Hospital (GMCH) for further medical treatment. On the basis of the said FIR, Azara P.S. Case No. 63/2026 under Sections 189(2)/109(1)/117(2) of the Bharatiya Nyaya Sanhita, Page No.# 3/3 2023 was registered. The case diary as called for has been produced. I have perused the bail objection filed by the Investigating Officer as well as the medical documents available in the case diary, where from it appears that the victim did not sustain any serious injury although some to the eye witnesses have implicated the present petitioner. Having regard to the nature of the injuries sustained as well as the nature of the allegations, further detention of the petitioner may not be necessary, provided necessary conditions are imposed. Accordingly, the prayer for bail is allowed. The petitioner shall be released on bail on furnishing a bail bond of Rs. 50,000/- with 2 sureties of the like amount to the satisfaction of the concerned Trial Court. It is further provided that the petitioner upon release shall not attempt to contact the victim or his family members and shall not try to influence them or any other persons acquainted with the facts of the case in any manner.
