GA HON'BLE MR. JUSTICE BHUWAN GOYAL Order 21/05/2026 1. This S.B. Criminal Misc. Application under Section 528 of BNSS, 2023 has been filed by the accused applicant for exemption of his personal appearance as he failed to appear before the trial court on first date of every month (in the event of Holiday, on the next day) pursuant to the order dated 19.1.2026 passed by this Court. 2. The accused applicant is present in person before this Court today. His signature has been obtained on the Court’s order sheet and he has been duly identified by his counsel. (2 of 2) [CRLMA-219/2026] 3. Learned counsel for the applicant submits that this Court while suspending the sentence of the applicant, vide order dated 19.1.2026 imposed the condition that he will appear before the trial court on first date of every month (in the event of Holiday, on the next day) for marking his presence. However, due to misunderstanding he could not appear before the trial court on the first date of every month for marking his presence. The reason for non appearance is bonafide, therefore, his presence before the trial court be exempted. He undertakes that now onwards the applicant will regularly appear before the trial court on first date of every month as per the order dated 19.1.2026 passed by this Court. 4. Learned Dy GA appearing for the State has opposed the same. 5. Taking into consideration the facts and circumstances of the case, the applicant is exempted from his personal appearance before the trial court on first date of every month from February, 2026 to May, 2026. Now, onwards the applicant shall regularly appear before the trial court on first date of every month for marking his presence as per the order dated 19.1.2026 passed by this Court. 6. Remaining part of the order dated 19.1.2026 shall remain unchanged. 7. The application stands disposed of accordingly. (BHUWAN GOYAL),J DK-S-228
