Issue a writ order or direction in the nature of Mandamus commanding and directing the respondents to complete the process of Demarcation in respect of land of khata number 00023 khasra no. 131 (Kha) (Me) Measuring .2153 Hectare in village SewlaKhurd Parana Pachwadun Tehsil and district Dehradun, within stipulated time period as may deem fit and proper by this Hon’ble Court. (28 to 30)” (3) Learned State Counsel, however, submits that application under Section 41 of Land Revenue Act lies before Assistant Collector, while petitioner has made application to an authority who is not competent to pass the order on the said application. He further points out that application was made less than a month ago, therefore writ petition is premature.
