10.03.2026 rc/ct.no.15 Item No.33 WPA No. 24486 of 2024 Suruchi Das Versus The State of West Bengal & Ors. Mr. Amit Kumar Ghosh ..for the petitioner Mr. Salil Kumar Maity Ms. Dolan Samanta …for the private respondent Mr. Lalit Mohan Mahata Mr. Ziaul Haque ..for the State The petitioner seeks demolition of allegedly unauthorized construction made by the private respondents. It is not in dispute that two Title Suits have been filed by the petitioner in respect of the same cause of action as in the writ petition prior to filing of the writ petition. The pendency of the title suits has not found place in the writ petition. In view of the above, this Court is inclined to hold that the petitioner has deliberately suppressed material fact before this Court. It is trite law that a person seeking relief before a court of law should come before the Court with clean hands. Herein, in view of deliberate suppression of material fact by the petitioner, she is not entitled to any relief in the writ petition. Accordingly, the writ petition is dismissed. There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh,J) 2
