JUSTICE S. B. PD. SINGH ORAL ORDER 2 31-03-2026 Heard the parties. 2. The instant application has been filed on behalf of petitioner for grant of the following reliefs:- “I. For directing the respondents to immediate dispose of the Title Appeal filed in Title Appeal No. 09 of 2018 pending in the Court of learned District Judge, Nawada within the time as framed by the Court. II. For commanding the respondents as to why the delay has been occurred in Patna High Court C.Misc. No.392 of 2026(2) dt.31-03-2026 3/4 disposing the title appeal as filed by the respondents specially the respondent no. 6 Bibi Sajida Begum @ Khatoon @ Sajida Khatoon and respondent no. 7 Mohammad Kausar Ali. III. For commanding the respondents despite specific directions passed by the Bench of this Hon’ble Court in CWJC No. 9548 of 2025 the delay has been occurred in disposing the appeal. IV. For commanding the respondents though the respondent no. 7 and 8 filed the writ application in CWJC No. 9548 of 2025, still the Title Appeal bearing No. 09 of 2018 has not been disposed of.” 3. Learned counsel for the petitioner submits that Title Suit No. 167 of 2005 was filed by the plaintiff/petitioner which was decreed. Against that judgment and decree defendant/respondent preferred Title Appeal No. 09 of 2018 which is pending before the Court of learned District Judge, Nawada. Learned counsel further submits that respondent of the present appeal has earlier filed a CWJC No. 9548 of 2025 in which a Co-ordinate Bench of this Court held as under:- 7. Since the grievance of the petitioner is that the Title Appeal Suit No. 9/2018 is not being taken to its logical conclusion despite the same having been filed in the year 2018, it is high time that the concerned Court takes up the matter Patna High Court C.Misc. No.392 of 2026(2) dt.31-03-2026 4/4 including any interim petition preferred by the petitioner and the same should be taken to its logical conclusion at an earliest preferably by the end of this year. 4. Learned counsel also submits that despite of aforesaid order, Title Appeal No. 09 of 2018 has not been decided till date. 5. In this view of matter, learned District Judge, Nawada, is again requested to dispose of the aforesaid Title Appeal at the earliest.
