In this writ application, the petitioner has prayed for providing physical protection to the petitioner and her family members from private respondent nos. 7 to 15 as they are threatening the petitioner and her family members to leave the village and earlier also assault was committed upon the son and daughter-in-law of the petitioner. It has been submitted by the learned counsel for the petitioner that after the death of the husband of the petitioner she has solemnized marriage with her brother-in- law who went to Jammu & Kashmir for his livelihood but he did not return. Learned counsel submits that the present writ application has been filed primarily to get a clue about her husband with whom she has had no contact for several years. It has further been submitted that the respondent nos. 7 to 15 are disturbing her possession in the property and several cases are going on between the parties. Mr. Devesh Krishna, learned S.C.(Mines)-III for the respondents while relying on the counter affidavit has submitted that an inquiry was conducted by the Police and it came to light that the husband of the petitioner is residing in the State of Jammu & Kashmir for the last 20- 25 years and in fact he has solemnized a second marriage Neutral Citation No. ( 2026:JHHC:1105-DB ) -3- which however has been vehemently denied by the learned counsel for the petitioner. It appears that no missing report or any kind of information was given to the concerned Police Station with respect to the husband of the petitioner having become traceless and in fact it is for the first time such grievance has been raised by filing this writ of Habeas Corpus. It further appears that there are five cases relating to partition of property which is going on, in which, the petitioner is a party. The petitioner has failed to make out a case for giving her as well as her family members protection from the respondent nos. 7 to 15 and, in fact, the assertions made in this writ application are all vague and unsubstantiated and considering the fact that the petitioner had not approached any State-authority with respect to the missing of her husband, we are not inclined to entertain this writ application which accordingly stands dismissed.
