ORAL ORDER In Crl.P.No.3135/2024, the petitioners are before this Court seeking the following prayers:
"WHEREFORE, the petitioners respectfully pray that, this Hon'ble Court be pleased to. a) Quash the charge sheet Dated: 09/12/2023 filed by the Peenya Police Station/respondent No.1 in C.C. No.2900/2024, pending on the file of the XXXI Additional Chief Metropolitan Magistrate at Bengaluru, for the offence punishable under section 498A, 354, 323, 504, 506 of Indian Penal Code, pursuant to cognizance
order dated 25.01.2024, passed in C.C.No.2900/2024 passed by the XXXI Additional Chief Metropolitan Magistrate at Bengaluru, taking cognizance and directing to register the criminal case for the offence punishable under section 498A, 354, 323, 504, 506 of Indian Penal Code. b) Grant such other relief/s as this Hon'ble Court deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity."
2. In Crl.P.No.2251/2026, the petitioners are before this Court seeking the following prayers:
"WHEREFORE, the petitioners most humbly prays that this Hon'ble Court may be pleased to allow this petition and quash the entire proceedings in C.C. No.2900/2024, which is pending on the file of the Court of learned XXXI Addl. Chief Judicial Magistrate, Bengaluru for the offences punishable under Sections.498A, 354, 323, 504, 506 of the IPC arising out of Crime No.431/2023 registered by the Peenya Police Station in the ends of justice."

3. In Crl.P.No.3135/2024, heard Sri.Venkat Satyanarayana A, learned counsel appearing for the petitioners, Sri.Vinay Mahadevaiah, learned HCGP appearing for respondent No.1, Sri.S.V.Srinivas,
learned counsel appearing for respondent No.2. In Crl.P.No.2251/2025, heard Sri.Venkat Satyanarayana A, learned counsel appearing for the petitioners, Sri.Vinay Mahadevaiah, learned HCGP appearing for respondent No.1, Sri.Chethan S.N.,
learned counsel appearing for respondent No.2 and have perused the material on record. 4. In Crl.P.No.2251/2026, the petitioner No.1 and respondent No.2 herein, who were parties to the lis before the Family Court in M.C.No.7523/2025 and have settled the dispute amongst themselves before the Family Court by terms of settlement. One of the term of the settlement is, closure of the present proceedings. The said Memorandum of settlement reads as follows:
"MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE MEDIATION) RULES,
2005. The parties above named submit as follows:-

I. The petitioner has filed this petition under Section 9 of the Hindu Marriage Act, 1955. II. The aforesaid petition was referred to mediation for resolving the disputes between the parties. In the course of mediation, the petitioner and the respondent along with their counsels were present, the parties identified each other and they resolved their disputes and have agreed to the following terms and conditions:
1. Both the parties state that their marriage was solemnized between the petitioner and the respondent on 01.05.2006 in the residence of the respondent at Mohara Kala Bera Uchada Village, Bewar District, Rajasthan as per Hindu rites and customs. 2. Due to irreconcilable differences and incompatibility the parties have been living separately from 2 years. 3. Both the parties state that they have 3 children born to them from this wedlock by name NIKHIL KUMAWATH, aged about 18 years and NIKHITHA KUMAWATH aged about 16 years and NELLU KUMAWATH aged about 15 years, taking the children welfare and future as the paramount interest both the parties herein undertakes not to persue this petition. 4. The parties further state that there has been no collusion or force, fraud or any undue influence in entering into this compromise in the aforesaid manner. 5. Both the parties herein state that, they have arrived at this agreement without pressing on the allegations leveled against each other orally or expressly in view of this agreement. 6. In view of this agreement the respondent agreed and undertakes to quash/close in C.C.2900/2024 filed against the petitioner and others, pending before 31st ACJM., Bengaluru filed u/s.498A, 506, 504 and 354 of IPC. III.
In view of the aforesaid agreement entered into between the parties, the petitioner and the respondent pray that this Hon'ble Court be pleased to dispose off as not to press this case. - 8 -

IV. The parties will appear on 16.12.2025 before the Hon'ble Court for passing orders in terms of the agreement."
5. Therefore, in light of the settlement arrived at by the parties as quoted supra and the offences not being against the State, I deem it appropriate to terminate the proceedings pending against these petitioners in the subject petitions. 6. For the aforesaid reasons, the following:
ORDER i. Criminal Petitions are disposed.
ii. In Crl.P.No.3135/2024, proceedings in C.C.No.2900/2024 pending before the XXXI Addl. CMM at Bengaluru, stands quashed, qua the petitioners.
iii. In Crl.P.No.2251/2026, proceedings in C.C.No.2900/2024 pending before the XXXI Addl. CJM Bengaluru, stands quashed, qua the petitioners.
