THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks the following reliefs. "a) CALL for entire records relating to the notification dated 18/1/2025 in No. KalaMa/HRD/Ne.Ne/1295/2024-25 passed by the 2nd Respondent vide Annexure-G PERUSE the same and declared the non consideration of the claim of the Petitioner for the posts of Assistant Engineers (Civil) in the Physically Handicapped quota of ST and HK category, as being arbitrary, illegal and violative of Article 14 and 16(1) of the Constitution of India and the principles of reservation; b) ISSUE a writ in the nature of mandamus directing the Respondents to consider the claim of the Petitioner under the Physically Handicapped quota reserved for ST and Hyderabad Karnataka and to issue order of appointment as expeditiously as possible by verifying the records and with all consequential benefits; - 3 - HC-KAR NC: 2026:KHC:16542 WP No. 4240 of 2025 c) PASS such other orders as this Hon'ble Court deems it appropriate in the ends of justice, in the interest of justice and equity." 2. When the matter came up before this Court on 11.08.2025, the following interim order was passed. "ORAL ORDER ON IA Nos.1 & 2 OF 2025 I.A.No.1/2025 is filed seeking dispensation of production of original/certified copy of Annexure-G. Perused the affidavit filed in support of the application. For the reasons stated in the accompanying affidavit, production of the original/certified copy of Annexure-G is dispensed with for the present, subject to the condition that same shall be furnished within a period of four weeks. Application stands disposed of. IA No.2/2025 is filed seeking a direction. The case of the petitioner is that, in respect of the Assistant Engineer, one post each are reserved for Scheduled Caste, Scheduled Tribe, 2A and General Merit in the physically handicapped quota. The petitioner belongs to Scheduled Tribe, Physically Handicapped quota. Even though the petitioner is entitled to be appointed under the said quota, no candidate has been appointed in the said quota. Therefore, the petitioner is seeking a direction to keep one post of physically handicapped Scheduled Tribe, vacant. None appears for the respondents and the respondents have not filed objections. - 4 - HC-KAR NC: 2026:KHC:16542 WP No. 4240 of 2025 In view of the above, the respondents are directed to keep one post of physically handicapped Scheduled Tribe, vacant, till the next date of hearing." 3. Though several contentions have been urged by both sides without expressing any opinion on the merits / de-merits of the rival contentions, I deem it just and appropriate to dispose of the present petition directing respondent No.2 to address the grievance of the petitioner and take appropriate decisions / appropriate orders in accordance with law pursuant to the representation/claim submitted and in terms of notification at Annexure - A dated 05.02.2024 within a period of two months from the date of receipt of copy of this order till the concerned respondents take appropriate decisions / take appropriate orders as stated supra, the aforesaid interim order dated 11.08.2025 shall continue in force and remain and operate between the parties. 4.
