Ray, AGA CORAM: JUSTICE V. NARASINGH Order No. ORDER 02.05.2026 01. 1. Heard learned counsel for the Petitioners and learned counsel for the State. 2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.208 of 2026 pending in the file of learned NGN-cum-J.M.F.C., Bhograi, arising out of Kamarda P.S. Case No.68 of 2026, for commission of offences punishable under Sections 126(2)/296/115(2)/118(1)/351(2)/3(5) of the BNS, 2023. 3. It is submitted that the because of the counter F.I.R., the Petitioners have been falsely implicated in the case at hand. 4. Such submission is opposed by learned counsel for the State since the investigation is at a nascent stage. p. 2 5. On going through the F.I.R., this.Court is not inclined to entertain the bail application of Petitioner No.1. However, it is directed that the Petitioner No.1- Shishir @ Sishir Kumar Rana may surrender before the learned NGN-cum-J.M.F.C., Bhograi in connection with the aforementioned case within one month from today. In the event of his surrender and motion for bail, the same be considered by the learned NGN- cum-J.M.F.C., Bhograi on merits, in the first hour of the day subject to verification of criminal antecedent. In the event of rejection of the prayer for bail by the learned NGN-cum-J.M.F.C., Bhograi, the Petitioner No.1 is at liberty to move the higher forum for bail in the second hour on the same day. 6. On being so moved, the higher forum is requested to make an endeavor to dispose of the bail application of the Petitioner No.1 on the same day. The case diary be made available to the concerned courts to facilitate disposal of the bail application of the Petitioner No.1 and learned NGN- cum-J.M.F.C., Bhograi is called upon to transmit the case record to the higher forum at the earliest in the event of rejection of such bail application. Ground of parity, if any, may be considered by the learned court(s) below. p. 3 7. So far as the Petitioner Nos.2 to 4 are concerned, it is directed that they shall surrender within three weeks hence and moving for bail, the Petitioner Nos.2 to 4-Tofan Sethi @ Biswajit Sethi, Rabindra Sethi @ Rabindra Kumar Sethi and Sujit Sethi @ Kalia Sethi respectively shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of the nature of the injury.
