Also heard Ms. B Deka, Learned Standing Counsel, Department of Elementary Education, Assam appearing for the Respondent Nos. 1, 2 & 4, and Ms. S Baruah, Learned Government Advocate appearing for Respondent No. 3. Mr. B Choudhury, Learned Counsel appears for Respondent No. 5. 2. The Petitioner, in the present Writ Petition, has prayed for a direction upon the Respondent No. 5, to continue with the DISE Code, as given to the Petitioner No. 2/School. The Petitioner, in the present Writ Petition, has projected that on receiving due permission and recognition, the Petitioner No. 2/School was operating. The Petitioner No. 2/School, in the meanwhile, was issued with a DISE Code in the year 2009 and
Page No.# 3/6 the Petitioner, was, thereafter, submitting its data every year. The name of the School earlier was Kapilipar S.E.U.M.E Madrassa. The name of the said School was changed to Kapilipar S.E.U.M.E School on 29.08.2025. Accordingly, necessary application was submitted before the District Elementary Education Officer (DEEO), Hojai, for applying the DISE Code granted earlier to the School, to be continued in the new name of the School. The Petitioner submits that the DISE Data for the year 2024-25, could not be uploaded during the month of September to November, 2024, on account of certain personal inconvenience faced by the Petitioner No. 1.
It is projected that he was suffering from ailments and was under treatment. It is submitted that the said aspect of the matter was brought to the notice of the Respondent No. 5, however, the same was not considered and presently, the DISE Code of the School of the Petitioner has been kept in abeyance, by holding that the School to be not operational. 3. Mr. A Roshid, Learned Counsel for the Petitioner submits that the School is continuing to function, even as on date. However, for the default, occasioning on part of the Petitioner
Page No.# 4/6 No. 1, in uploading the DISE Data of the School for the 2024-25 and 2025-26, the School has been shown in the DISE Data, to be non-operational. 4. Mr. B Choudhury, Learned Counsel appearing for Respondent No. 5, submits that the DISE Code granted to a School is continued from year to year, provided that the School authorities upload the DISE Data, in the prescribed format, on regular basis, during the time period mandated for the same. The Petitioner No. 2/School, having not uploaded its DISE Data for the year 2024-25 and 2025-26, the DISE Code, granted to the School, was kept in abeyance and the school was held to be non-operational. Mr. B Choudhury, Learned Counsel appearing for Respondent No. 5, submits that in the event, the School wants to have a DISE Code, they will now have to submit a fresh application, in the prescribed format, before the competent authority and the competent authority, on verifying the particulars so submitted, shall consider granting fresh DISE Code to the Petitioner No. 2/School. 5. Mr. A Roshid, Learned Counsel for the Petitioner submits
Page No.# 5/6 that the Petitioner No. 2/School, shall submit appropriate application, in the prescribed format, before the competent authority for grant of a fresh DISE Code in name of the School. 6.
In view of the above agreement arrived at by and between the Parties to the proceeding, the Petitioner is directed to approach the jurisdictional District Elementary Education Officer (DEEO) cum District Mission Coordinator, SSA, within a period of 2 (Two) months from today, along with the data of the School, required to be captured in the DISE Code, in the prescribed format. The District Elementary Education Officer (DEEO) cum District Mission Coordinator, SSA, on receipt of such application from the Petitioner, in the prescribed format, complete in all respects, shall verify the particulars, as entered, therein, and in the event the Petitioner No. 2/School is found to be operational and satisfying the requirements for being issued with a fresh DISE Code, shall proceed to take all requisite steps for facilitating issuance of a fresh DISE Code, to the School in question, within a period of 6 (Six) months from the date of such application, along with a certified copy of the present order, from the Petitioner, herein.
