Heard Mr. B. M. Choudhury, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, Shehnaj Begum @ Tikli has prayed for releasing her on bail after she was arrested in connection with Jorhat P. S. Case Page No.# 2/2 No.170/2026, under Sections 21(b)/25/27A/29 of the NDPS Act, 1985. 3. Sobiruddin Rahman @ Tetera, the brother of the present petitioner is a drug addict. From the residence of the present petitioner, 12.82 gms of narcotic drugs was recovered. 4. From the records it appears that nothing was recovered from the possession of the present petitioner and she has already spent about 15 days in judicial custody. 5. Learned Additional Public prosecutor has objected to this bail application. 6. Having considered the submissions made by the learned counsel of both sides and having considered the facts that the petitioner has already spent about 15 days in judicial custody, this Court is of the opinion that the petitioner no longer deserves to be detained in custody. Therefore, her bail application is allowed. 7. The petitioner, Shehnaj Begum @ Tikli, who was arrested in connection with Jorhat P. S. Case No.170/2026, under Sections 21(b)/25/27A/29 of the NDPS Act, 1985 shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Special Judge, Jorhat. 8.
