JUSTICE M.NAGAPRASANNA ORAL COMMON ORDER The petitioners are before this Court calling in question the proceedings in CC No.24571 of 2023 before the VIII Additional Chief Metropolitan Magistrate, Bengaluru, registered for offences punishable under Sections 498A, 313, 323, 504 and 506 of IPC and Sections 3 an 4 of DP Act. 2. Heard Sri P B Tumbigi, learned counsel appearing for the petitioners, Sri B N Jagadeesha, learned Additional SPP appearing for respondent No.1, Sri S N Basavaraju, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. We submit that, (1) Siddesh.K, (2) Sowmya.K, (3) Sri.G.Katappa, (4) Smt.S.Devaki, (5) Sri.Chidambar.H.M are the petitioners and Smt.Goutami.N is the 2nd respondent in the above case and we swear this Joint Affidavit. 2. The respondent No.2 in the above case was the complainant before the Hon'ble Trial Court and her marriage was solemnized on 10.08.2022 with the accused No.1 and the respondent No.2 herein had filed a dowry harassment case against the petitioners herein and same was registered on 17.03.2023 in Crime No.75/2023 for the offences punishable under sections 506, 498(A), 504, 420, 313, 323, 354, 417 of Indian Penal Code and sections 3 & 4 of Dowry Prohibition Act. 3. That the 1st respondent police after investigation filed the charge sheet on 15.09.2023 in CC.No.24571/2023 for the offences punishable under sections 498(A), 313, 323, 504, 506 of Indian Penal Code and sections 3 & 4 of Dowry Prohibition Act, pending on the file of the VIII Additional Chief Metropolitan Magistrate, Bengaluru. The Hon'ble Trial Court took the cognizance of the offences and issued notice to the petitioners. - 6 - HC-KAR NC: 2026:KHC:23054 CRL.P No. 4715 of 2026 C/W CRL.P No. 10011 of 2023 4. That the petitioners have challenged the proceedings in CC.No.24571/2023 before this Hon'ble Court and this Hon'ble Court after hearing was pleased to stay the proceedings. The petitioner/accused No.1 filed Crl.P.No.4715/2026 before this Hon'ble Court which was clubbed with earlier Crl.P.No.10011/2023. 5. The petitioners and the respondent No.2 amicably settled their dispute on the advised of the friends and family members and in view of the same, the petitioners and the respondent No.2 have approached the Hon'ble Principal Civil Judge and JMFC, Chitradurga in Crl.Misc. No.1125/2023 by filing a memo to close the case stating that, matter is settled between them outside the Court and the respondent No.2 herein has received Demand Draft for Rs.14 Lakhs as permanent alimony from the petitioners and same was closed. 6. The petitioners and the respondent No.2 again approached the Family Court in MC No.49/2025 and closed the case in view of the above settlement. The respondent No.2 has no intention to continue the criminal case registered against the petitioners in CC.No.24571/2023 for the offences punishable under sections 498(A), 313, 323, 504, 506 of Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act on the file of the VIII Additional Chief no objection to quash the proceedings of the Trial Court pending against the petitioners by allowing the above criminal petitions. 7. That the dispute is settled voluntarily without any coercion, undue influence and threat etc., from either side and the settlement is genuine, apart from that, the 2nd respondent withdrawn the case between her and the accused No.1/petitioner, the respondent No.2 has no objection to quash the proceedings by allowing the above cases, in the interest of justice. 8. If this application is not allowed, we will be put to great hardship, injury and on the other hand no prejudice will be caused to the other side by allowing the same. For the aforesaid reasons, the following: ORDER i. Criminal Petition stands disposed. ii. Proceedings pending in CC No.24571 of 2023 before the VIII Additional Chief Metropolitan Magistrate, Bengaluru, against the petitioners stands quashed.
