This Bail Application under Section 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been filed to release the petitioner on regular bail in connection with Nimiaghat P.S. The case is presently pending before the Court of learned Special Judge, POCSO Act, Giridih. 2. Heard learned counsel representing the petitioner and learned A.P.P. representing the State. Perused the material available on record and also gone through the impugned order. 3. Learned A.P.P. representing the opposite party – State, opposes the prayer for bail. 4. There is an allegation that one of the co-accused namely Naushad, enticed the victim girl, took her to a house and tried to rape her by locking her in a room. On hearing her scream, people gathered at the place of occurrence and the Police also reached there. It is further alleged that on seeing the crowd, co-

accused Naushad called his two friends, one of whom was this petitioner. It is alleged that this petitioner and another friend of Naushad reached there and scuffled with the crowd. 5. Considering the fact that there is no allegation against this petitioner of committing sexual assault or trying to entice or kidnap the victim. The only allegation is that he came to rescue of his friend, thus I am inclined to allow this application. 6. Accordingly, this Bail Application is allowed.
The petitioner above named is directed to be released on bail in connection with Nimiaghat P.S. Case No.91 of 2025, corresponding to POCSO Case No.152 of 2025, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Act, Giridih, subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his / her own name within the State of Jharkhand.
