The Court made the following Order:-
The learned counsel for the petitioner submits that the petitioner was entrusted with the execution of the works. The grievance of the petitioner is with regard to the action of the respondents in withholding the admitted and due amounts of Rs.87,696/-, Rs.78,420/-, Rs.32,718/-, Rs.95,648/-, Rs.28,447/-, Rs.35,516/-, Rs.35,173/-, Rs.30,595/-, Rs.27,755/-, Rs.32,718/-, Rs.32,718/-, Rs.28,500/-, Rs.32,718/-, Rs.37,212/- and Rs.38,430/-, respectively, totaling Rs.6,52,264/- (Rupees Six Lakhs Fifty-Two Thousand Two Hundred and Sixty-Four Only), payable to the petitioner in respect of the aforesaid 15 works executed by the petitioner under their respective work orders, as set out in Annexure-I, despite finalization of the said bills, is illegal, arbitrary, unjust, unreasonable and unconstitutional.
Consequently, the respondents herein may be directed to forthwith release and pay the total admitted and due amount of Rs.6,54,264/- (Rupees Six Lakhs Fifty-Four Thousand Two Hundred and Sixty-Four Only) pertaining to the aforesaid 15 works under the Bills for Contingent Charges (C-Bills) payable to the petitioner in respect of the execution of the following works., (i) Engaging of Tractor for door-to-door garbage collection and daily sanitation activities in 62, 63 and 66 Ward Secretariats of 1st Circle from 28/08/2025 to 15/09/2025 in Ananthapuramu Municipal Corporation; (ii) Providing of Protection Wall in District Officers Residence in 10th Division, Ananthapuramu Municipal Corporation; (iii) Engaging of water tanker of 6 KL for watering of Avenue plants from 16th November to 22nd November in Ananthapuramu Municipal 4 Corporation; (iv) Engaging of JCB and tractor with trolley on hourly hire basis for desiltation at Ram Nagar area from 21.08.2025 to 22.08.2025 in Ananthapuramu Municipal Corporation; (v) Engaging of water tanker of 6 KL for watering of Avenue plants from 12th September to 19th September in Ananthapuramu Municipal Corporation; (vi) Engaging of Tractor for door-to- door garbage collection and daily sanitation activities in 62, 63 and 66 Ward Secretariats of 1st Circle from 09/11/2025 to 15/11/2025 in Ananthapuramu Municipal Corporation; (vii) Repairs for open gym equipment in Janma Bhoomi Park, Court Road in Ananthapuramu Municipal Corporation; (viii) Engaging of JCB and Tractor for site clearance at HLC Canal Bund for tree plantation in 50th Division of Ananthapuramu Municipal Corporation; (ix) Engaging of JCB and Tractor on hire basis for removal of silt near NH-44 Service Drain, Culvert and Gourav Garden during day Swachh Andhra–Swarna Andhra (SASA) Programme on 23.08.2025 in Ananthapuramu Municipal Corporation; (x) Engaging of water tanker of 6 KL for watering of Avenue plants from 1st November to 7th November in Ananthapuramu Municipal Corporation; (xi) Engaging of water tanker of 6 KL for watering of Avenue plants from 8th November to 15th November in Ananthapuramu Municipal Corporation; (xii) Providing of Iron Sheet on Manhole grill to Open Major Drain in 20th Division in Ananthapuramu Municipal Corporation; (xiii) Engaging of water tanker of 6 KL for watering of Avenue plants from 19th October to 31st October in Ananthapuramu Municipal Corporation; (xiv) Providing of Pipes, fittings and water tanks for Modular toilets at Study Park in Ananthapuramu Municipal 5 Corporation; and (xv) Providing of Manhole grill on open major Drain at D. No. 28-388 in
20th Division in Ananthapuramu Municipal Corporation, Ananthapuramu. 2. It is submitted that the petitioner had completed the works entrusted to him and that the competent authority of the respondents had also approved the payment due and payable to the petitioner. The respondents have also recorded the progress of the works and the amounts due and payable to the petitioner in the M-Book. 3. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, Sri P Vengala Reddy, learned Standing Counsel for the respondent Municipality, and the learned Assistant Government Pleader for Finance and Planning. 4. During the course of hearing, the learned Standing Counsel appearing for the respondent Municipality submits that the works have been completed and that the petitioner has also submitted the final bills and the amounts due and payable to the petitioner have been duly admitted. It is submitted that further funds are awaited and that, soon after the release of the funds, the bills due and payable to the petitioner shall be cleared. 5. Recording the submissions, this writ petition is disposed of at the admission stage, directing the respondents to verify and release the payments due and payable to the petitioner as expeditiously as possible, preferably
