The plaintiff has instituted the present suit for recovery of money. The cause of action has arisen within the jurisdiction of this Court, but however, the defendant/Trust is located outside the jurisdiction of this Court, and hence, this application is filed. 3. Considering the nature of the relief sought for and the cause of action which is within the jurisdiction of this Court and that the defendant is located outside the jurisdiction of this Court, and also taking into account the facts and circumstances of this case, leave is granted, This application is allowed. 5.
