JUSTICE PRAVEER BHATNAGAR
Order 21/05/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 371/2025 registered at Police Station Sodala, District Jaipur City (South) for the offences under Sections 318(4), 316(2) and 61(2) of BNS.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that from the perusal of the FIR it would reveal that there is a money dispute between the parties. It is stated that complainant invested some money on the petitioner's assurance but it did not yield any profit. The accused-petitioner is in custody since 28.01.2026 and the trial/investigation of the case may take
[2026:RJ-JP:21599] (2 of 2) [CRLMB-7887/2026] considerable time, therefore, the bail application of the accused- petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that petitioner is a habitual offender as he is found to be involved in three other cases, therefore, considering the above facts, his bail application deserves to be dismissed.
4. Heard and perused the material available on record.
5. Considering the arguments advanced by learned counsel for the parties and looking to the fact that the accused-petitioner is in custody since 28.01.2026 and the trial/investigation of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Pankaj Kumar Meena S/o Indra Kumar Meena @ Ashok Kumar Sharma, in connection with FIR No. 371/2025 registered at Police Station Sodala, District Jaipur City (South) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
