1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 17/2026 registered at Police Station Bagad Tiraya, District Alwar for the offences under Sections 318(4), 319(2) and 316(2) of BNS and Section 66D of IT Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the main allegation of committing cyber crime is against the other co-accused Sharukh Khan. The co-accused Sharukh Khan has transferred the amount in the account of the petitioner. The co-accused has already been enlarged on bail by this Court vide order dated 18.04.2026. The accused-petitioner is in custody since long and the trial of the case may take
[2026:RJ-JP:21541] (2 of 2) [CRLMB-6902/2026] considerable time, there are no criminal antecedents against the accused-petitioner, therefore, the bail application of the accused- petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application.
4. Heard and perused the material available on record.
5. Considering the fact that the main allegation of committing cyber crime is against the other co-accused Sharukh Khan. The co-accused Sharukh Khan transferred the alleged amount in the account of present petitioner. There is no allegation against the petitioner that he using his mobile phone committed any cyber crime, therefore, considering the aforesaid facts, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mustafa Khan S/o Sharif Khan, in connection with FIR No. 17/2026 registered at Police Station Bagad Tiraya, District Alwar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
