02/Dated: 05th February, 2026
1. Heard the learned counsel for the petitioner.
2. The present Civil Miscellaneous Petition has been filed for the following relief:-
“For quashing the order dated 04.11.2025 passed by Shri Vishal Srivastava, District Judge 1. Ramgarh whereby petition filed by the Applicant being MCA no. 07/2023, whereby the application filed under Order VII Rule 11 of the CPC, challenging the maintainability of the Probate Case no. 04/2008, being hopelessly barred by limitation, has been rejected.”
3. It appears that a petition has been filed for rejection of plaint under
Order VII Rule 11 of the Code of Civil Procedure, 1908. Subsequently, amendment petition has been filed by the plaintiff disclosing the cause of action and it is within the period of limitation as per the plaintiff.
4. The period of limitation is mixed question of law. The Trial Court is mandated to frame it as an issue, either as a preliminary issue or along with the other issues.
5. In that view of the matter, I am not inclined to entertain the present Civil Miscellaneous Petition. Accordingly, the same is hereby, disposed of.
6. However, the petitioner is at liberty to raise all the pleas in the pending proceedings.
