Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, Sariful Islam @ Md. Sariful Islam, who is facing trial in Special NDPS Case No.57/2025, under Section 21(b) of the NDPS Page No.# 2/2 Act, 1985, pending in the Court of the learned Special Judge, Sonitpur, Tezpur. 3. On some dates, the petitioner could not appear before the Court below because he was admitted in a drug rehabilitation center. The petitioner has already spent about 35 days in judicial custody. 4. This Court is of the opinion that the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed. 5. The petitioner, Sariful Islam @ Md. Sariful Islam, who is facing trial in Special NDPS Case No.57/2025, under Section 21(b) of the NDPS Act, 1985 shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Special Judge, Sonitpur, Tezpur. 6. The petitioner is directed to regularly appear before the Trial Court on each and every date of hearing. If he fails to do so, the Trial Court shall have the liberty to procure his attendance by due process of law. 7. With the aforesaid direction, this bail application stands disposed of.
