The applicant has preferred this First Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as they have been arrested in connection with Crime No.220/2025, registered at Police Station- Gandhinagar, District- Sarguja (C.G.) for the offence punishable under Section 22(c) of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’). 2. The prosecution story, in brief, is that on 04.04.2025, while on patrol duty, 50 ampoules of Talgesic Buprenorphine Injection IP 02 ml and 50 vials of Avil Pheniramine Maleate Injection IP 10 ml were allegedly recovered from the applicant (the accused). Additionally, 50 ampoules of Talgesic Buprenorphine Injection IP 02 ml and 50 vials of Avil Pheniramine PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.02.05 12:13:45 +0530 2 Maleate Injection IP 10 ml were recovered from the co-accused, Prahlad Vasudev. On the basis of the aforesaid facts, an offence was registered against the applicant under Section 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. After completion of the investigation, a final report has been submitted for the offence punishable under Section 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that there is no material on the hand of the prosecution to connect the applicant with the above mentioned crime. It is also submitted that the charge-sheet has already been filed and that the applicant has been in judicial custody since 04.04.2025. Further, the applicant has 10 previous criminal antecedents, which have been explained in paragraph No. 4(a) of this bail application. As the conclusion of the trial is likely to take considerable time, learned counsel prays for grant of bail to the applicant. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the charge-sheet has been filed. He further submits that 50 ampoules of Talgesic Buprenorphine Injection IP 02 ml and 50 vials of Avil Pheniramine Maleate Injection IP 10 ml were allegedly recovered from the applicant, which is much more than the commercial quantity. Hence, his bail application is liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that 50 ampoules of Talgesic 3 Buprenorphine Injection IP 02 ml and 50 vials of Avil Pheniramine Maleate Injection IP 10 ml were allegedly recovered from the applicant, which is much more than the commercial quantity, and the applicant has failed to give any explanation for the same and it cannot be said to be a case of false implication, further, the applicant has 10 previous criminal antecedents, which have been explained in paragraph No. 4(a) of this bail application accordingly, the bail application of applicant – Sagar Singh Chouhan involved in Crime No.220/2025, registered at Police Station- Gandhinagar, District- Sarguja (C.G.) for the offence punishable under Section 22(c) of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’), is rejected at this stage. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8.
