Heard Mr. A.K. Azad, learned counsel for the petitioner. Also heard the learned Additional Public Prosecutor. This is an application filed under Section 483 of BNSS, 2023 for enlarging the accused person on bail, who was arrested on 03.06.2026 in connection with

2023. The facts in brief are that on 02.06.2026, complainant Jugal Kalita S/o late Paneswar Kalita of Dharapur Geumaj, P.S Azara, Kamrup (M), Assam lodged an FIR stating that his son Nirban Kalita, an employee of Snowman Company, situated at Azar Mizapur, was informed by one Sahidul Ali that a company employee namely, Mustafa Ali had entered the company’s bathroom with a girl and encouraged him to record a video. Subsequently, Mustafa Ahmed, Sahidul Ali and their goons called Nirban to Dharapur, Majali and brutally assaulted the complainant’s son with the intention to kill and causing grievous injuries. After seeing the incident, local residents rescued him and took him to Garal MPHC, from where he was referred to GMHC due to the seriousness of his injuries. The case diary as called for has been produced. I have perused the bail objection filed by the Investigating Officer as well as the medical documents available in the case diary, where from it appears that the victim did not sustain any serious injury although some of the eye witnesses have implicated the present petitioner. Having regard to the nature of the injuries sustained as well as the nature of the allegations, further detention of the petitioner may not be necessary, provided necessary conditions are imposed. Page No.# 3/3 Accordingly, the prayer for bail is allowed. The petitioner shall be released on bail on furnishing a bail bond of Rs. 50,000/- with 2 sureties of the like amount to the satisfaction of the concerned Trial Court.
It is further provided that the petitioner upon release shall not attempt to contact the victim or his family members and shall not try to influence them or any other persons acquainted with the facts of the case in any manner.
