The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to quash the impugned order dated 09.07.2024 (Annexure P/1) passed by the District Education Officer, District – Gaurella – Pendra – Marwahi, C.G. till the extent to the private respondent. 10.2 That, this Hon'ble Court may kindly be pleased to direct the Respondent State to count the seniority of the petitioner w.e.f. 23.07.1997 as per the gradation list dated 01.04.2019 over and above the private respondents. 10.3 That, this Hon'ble Court may kindly be pleased to direct the Respondent State to consider the petitioner for promotion on the post of Assistant Grade – III w.e.f. 09.07.2024 along with all consequential benefits w.e.f. 09.07.2024. 10.4 That, any other relief(s) which the Hon’ble Court deems fit & proper may kindly be pleased to granted in favour of the petitioner.” 2. Learned counsel for the petitioner submits that the Respondent No. 2 has issued an order of promotion dated 19.07.2024 promoting the juniors of the petitioner. Petitioner after getting knowledge of his supersession by his juniors, had verified the fact upon which, it revealed that the seniority of the petitioner has not been fixed at appropriate place in the gradation list. Upon asking learned counsel for petitioner as to whether the petitioner has approached the concerned authorities raising all the grievance as raised in this writ petition, she submits that in the writ petition no such documents have been enclosed. 3. On the other hand, learned counsel for the Respondents/State would submit that he may be granted time to file reply. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner and that in the seniority list name of the petitioner has not 3 been placed appropriately in the gradation list and thereby, juniors to the petitioner have been promoted, in the facts of the case, this writ petition at this stage is disposed of permitting the petitioner to submit a comprehensive representation along with all supporting documents before the Respondents No. 2 & 3 and if such a representation is submitted by the petitioner, concerned authority shall consider and take decision on the representation to be submitted by the petitioner on its own merits in accordance with law, expeditiously, preferably within a period of 03 months from the date of receipt of representation. 6.
