...Respondents 2 VS,J W.P.No.38606 of 2018 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an order or direction or an appropriate writ, more particularly one in the nature of a Writ of Mandamus, declaring the proceedings issued by the 2nd respondent issued vide Proceedings No.M1/9580/2016 dated 05.07.2016, communicated to the 4th respondent, intimating against registration of the documents in respect of the property situated in Sy.No.13, 15, 17/5 of Avilala Village, Tirupathi Rural Mandal, Chittoor District, as illegal, arbitrary, ultra vires, unconstitutional, violative of Articles 14, 21 and 300A of the Constitution of India and consequently to set aside the same by directing the 4th respondent to receive an register the document of sale deed being presented relating to the said property, and pass IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 4th respondent to receive and register the document of sale deed being presented relating to the said property situated in Sy.No.13, 15, 17/5 of Avilala Village, Tirupathi Rural Mandal, Chittoor District by suspending the Proceedings No.M1/9580/2016 dated 05.07.2016 issued by the 2nd respondent herein, pending disposal of the above Writ Petition, and pass IA NO: 2 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to implead Sri Swamy hathiramji mutt, Tirupathi, Chittoor District, represented by its Mahanth as Respondent No.5 in WP.No. 38606/2018 and Interlocutory Applications fined therein and pass IA NO: 1 OF 2019 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to 3 VS,J W.P.No.38606 of 2018 vacate the interim orders dated 06.12.2018 in IA No.1/2018 in WP No.38606/2018 and to pass Counsel for the Petitioner: NAGAM CHANDRASEKHAR REDDY Counsel for the Respondents: GP FOR REGISTRATION AND STAMPS (AP) Counsel for the Respondents:GP FOR ENDOWMENTS (AP) The Court made the following 4 VS,J W.P.No.38606 of 2018 ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “… to issue an order
or direction or an appropriate writ, more particularly one in the nature of a Writ of Mandamus declaring the proceedings issued by the 2nd respondent issued vide Proceedings No.M1/9580/2016 dated 05.07.2016, communicated to the 4th respondent, intimating against registration of the documents in respect of the property situated in Sy.No.13, 15, 17/5 of Avilala Village, Tirupathi Rural Mandal, Chittoor District, as illegal, arbitrary, ultra vires, unconstitutional, violative of Articles 14, 21 and 300A of the Constitution of India and consequently to set aside the same by directing the 4th respondent to receive and register the document of sale deed being presented relating to the said property….” 2. When the writ petition came up for admission on 06.12.2018, this Court passed the following interim order:
“….the 4th respondent is directed to receive and register the document presented by the petitioner in respect of subject property, if no injunction regarding non-alienation is operating in respect of the same and also that the registration shall be treated as provisional registration, which will be subject to further orders in the writ petition. However, petitioners shall not claim any equity and there shall not be further alienation in respect of subject property.”
3. Today, when the matter came up for hearing, Ms.T.Jyothi, learned counsel representing Mr.Nagam Chandrasekhar Reddy, learned counsel for the petitioner, submitted that, in view of the interim order dated 06.12.2018 passed by this Court, no further orders are necessary in the writ petition. 5 VS,J W.P.No.38606 of 2018
4. Recording the said submission, the Writ Petition is closed. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. ___________________ JUSTICE V.SUJATHA
