2. Petitioner is resident of village Ransura, P.S. Laksar, District Dehradun. By means of this writ petition, he has sought following reliefs:
“a) Issue a writ, order or direction in the nature of Mandamu commanding the respondent authorities to consider and decide the representation dated 08.11.2025 and to conduct a spot inspection/demarcation of the public well situated in Village Ranasura, Gram Panchayat Ranasura Mukkarpur, Tehsil Laksar, District Haridwar, and thereafter remove the illegal encroachment/ construction raised thereon in accordance with law within a time-bound period.
b) Issue a writ,
order or direction commanding the respondent authorities to ensure that no further illegal construction or encroachment is raised over the aforesaid public utility land.”

Learned counsel for the petitioner

2026:UHC:5738 submits that respondent No. 4 has encroached upon a public well by raising construction and he is also dumping sewerage and other waste in the public well. In this regard, petitioner has made a representation to SDM concerned on
08.11.2025.
Learned counsel for the petitioner submits that SDM be directed to take decision on that representation.
4. Learned State Counsel submits that he has no objection if the writ petition is
disposed of in terms of prayer made by petitioner’s counsel.
5. The writ petition is, accordingly,
disposed of with direction to SDM concerned to take decision on the representation dated 08.11.2025 within 10 weeks from date of presentation of certified copy of this order.
6. It goes without saying that respondent No. 4 or any other stakeholder, if any, shall also be heard before taking any decision on the representation.
