2026:HHC:18353 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA. LPA No. 274 of 2026 Date of decision: 18.05.2026 Himachal Pradesh State Electricity Board Ltd. & Anr. …Appellants Versus Om Singh …Respondent Coram The Hon’ble Mr. Justice G. S. Sandhawalia, Chief Justice. The Hon’ble Mr. Justice Bipin C. Negi, Judge. Whether approved for reporting? For the Appellants: Ms. Sunita Sharma, Senior Advocate with Mr. Saurav Upadhyay and Mr. Dhananjay Sharma, Advocates. G. S. Sandhawalia , Chief Justice (Oral) Consideration in the present Letters Patent Appeal is sought to the order passed by the learned Single Judge in CWP No. 2268 of 2023, titled as Om Singh vs. HPSEB Ltd. & Anr., decided on 07.11.2025, whereby the learned Singh Judge has disposed of the writ petition directing the appellants to consider the case of the petitioner in light of the terms of the judgment rendered in CWP No. 2269 of 2023, titled as Deep Ram vs. HPSEBL & Anr., decided on 17.09.2025. 2. It is to be noticed that in LPA No. 35 of 2026, HPSEB Ltd. & Anr. vs. Deep Ram, we have already upheld another order passed in CWP No. 2269 of 2023, titled as Deep Ram vs. HPSEB Ltd. & Anr., dated 17.09.2025, whereby the 2 2026:HHC:18353 present appellants were directed to pay 50% wages to the employee in the pay scale of Rs. 2720-4475/- w.e.f. 15.09.2003 to 13.09.2009 and full wages from 14.09.2009 in the corresponding revised scale. The relief claimed in the writ petition filed by the employee in the present case is also the same. 3. It is pertinent to mention that dispute as such is to the common award dated 12.08.2008, passed by the Industrial Tribunal-cum-Labour Court, Shimla, which was earlier a subject matter in LPA Nos. 43 & 44 of 2013, titled as HPSEB Ltd. & Anr. vs. Narayan Singh & Ors., alongwith connected matter decided on 30.04.2014, and the matter had been remanded. Thereafter, the Labour Court had decided the Reference No. 151 of 2001 filed by the eight workmen, on 14.08.2014. Deep Ram was also one of the employees in the said case, which order has been upheld, as noticed. 4. Similarly, in LPA No. 45 of 2026, titled as HPSEB Ltd. & Anr. vs. Narain Singh, decided on 16.04.2026 and in LPA No. 46 of 2026, HPSEB Ltd. & Anr. vs. Khajan Singh, decided on 29.04.2026, we have also dismissed the LPAs of the Electricity Board keeping in view the fact that the issue now squarely stands covered, upholding the order(s) of the learned Single Judge as such, which was emanating from the Labour Court order dated 14.08.2014. 3 2026:HHC:18353 5. In such circumstances, the matter being covered and for the reasons given in the Deep Ram’s case (supra), the present appeal also stands squarely covered by the same. Accordingly, the appeal is dismissed, so also pending applications, if any. (G. S. Sandhawalia) Chief Justice (Bipin C. Negi) 18th May, 2026 Judge (sanjeev)
