Respondent no. 5 has been permitted to open a retail shop of Indian Made Foreign Liquor in near vicinity of petitioner’s shop. Petitioner wants that shop to be removed from his vicinity. 5. The relief as claimed, cannot be granted in a writ petition. 6. Since petitioner has a remedy under Section 11(2) of the Excise Act, therefore, the writ petition is disposed of with liberty to petitioner to avail that remedy. Petitioner shall be at liberty to approach this Court, if his revision is decided against him. Respondent no. 5 shall also be given reasonable opportunity of hearing before deciding petitioner’s revision.
