JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question registration of a crime in Crime No.79/2024, pending before the Principal Civil Judge (Jr. Dn.) and JMFC Court, Anekal, Bengaluru Rural, for the offences punishable under Sections 498A, 504, 506, 323 and 114 r/w. 34 of the IPC. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the family court in M.C.No.206/2023 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking quashment of the proceedings by permitting them to compound the offences. The couple have obtained a decree of divorce from the hands of the concerned Court. The parties have filed an application under Section 320(2) of the Cr.P.C. and a joint verifying affidavit of the parties, before this Court. 3. The application reads as follows: - 4 - HC-KAR NC: 2026:KHC:8674 CRL.P No. 3349 of 2024 “3. The parties assert that following the aforementioned actions, multiple mediation sessions took place involving friends and relatives, ultimately leading to a resolution of the dispute. It is stated that the Respondent No.2 along with her parents, consented to resolve the issues and the parties took divorce in MC. NO. 206/2023 on the file of the Senior Civil Judge and JMFC, at Anekal, which included the 2nd respondent committed to withdrawing all pending criminal cases against the petitioners, and petitioner No. 1 and his family members also agreed to this arrangement. 4. Consequently, the parties respectfully submit to this Honorable Court that, in light of the aforementioned settlement and circumstances, they kindly request permission to compound the offense. They further pray for the issuance of an acquittal order or for the quashing of FIR No. 79/2024, which was registered by the first respondent, alleging offenses under Section 498A, 504, 506, 323 and 114 r/w section 34 of the Indian Penal Code. 5. The parties submits that if the application is not allowed, they will face significant hardship. Therefore, they respectfully request that this Honorable court may kindly allow the application in the interest of justice.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the application and the joint verifying affidavit and terminate the proceedings against the petitioners, as the allegations are not against the State. - 5 - HC-KAR NC: 2026:KHC:8674 CRL.P No. 3349 of 2024 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The impugned crime in Crime No.79/2024, pending before the Principal Civil Judge (Jr. Dn.) and JMFC Court, Anekal, Bengaluru Rural, stands quashed.
