Setia, the learned counsel appearing on behalf of Mr. T.H. Hazarika, the learned Page No.# 2/3 counsel for the petitioner. Also heard Mr. D. Talukdar, the learned counsel for the sole respondent. [2] This application under Section 24 of the Code of Civil Procedure, 1908 has been filed by the petitioner, namely, Urbashi Baruah, praying for transfer of the Title Suit (M) No. 165/2025, pending before the court of the learned Additional District Judge, Jorhat, Assam to the court of the learned Principal Judge, Family Court No. 1, Kamrup(M) at Guwahati. [3] The learned counsel for the sole respondent submits that since there are other litigation pending between both the parties in the Kamrup(M) district. Hence, the respondent does not have any objection if the prayer of the present petitioner for transferring the aforesaid case is allowed. [4] In view of the submissions of learned counsel for the respondent, the prayer is allowed. [5] Let the records of Case No. Title Suit (M) No. 165/2025, pending before the court of the learned Additional District Judge, Jorhat, be transferred to the learned Principal Judge, Family Court No. 1, Kamrup(M). [6] Since both the parties are represented by their engaged counsel before this court. Hence, both the parties are directed to appear before the court of the learned Principal Judge, Family Court No. 1, Kamrup(M) in connection with the Title Suit (M) No. 165/2025 (may Page No.# 3/3 be re-numbered in the Family Court) on the next date fixed, i.e., 5th August, 2026. [7] The court of the learned Additional District Judge, Jorhat shall ensure that records of the aforesaid case reaches the court of the learned Principal Judge, Family Court No. 1, Kamrup(M) before the aforesaid date.
