The petitioners are apprehending their arrest in connection with connection with Haidernagar P.S. Case No. 77 of 2025, registered under Sections 317(5) and 3(5) of the Bhartiya Nyaya Sanhita, 2023, pending in the court of Learned Judicial Magistrate, 1st Class, Daltonganj. 3. Learned counsel appearing for the petitioners submits that the allegations are there that on a Swift Dezire car, diesel was being carried. He next submits that the petitioners are agriculturist and they are having the tractor and Bolero vehicle and for personal use and they have purchased the said diesel and buttress to this argument, he refers to Annexure-3, which is the cash memo issued by M/s Ganpati Fuel Center of village Haraiya, in the district of Garhwa. He also submits that the petitioners have got no criminal antecedent as disclosed in para 11 of the petition. 4. Learned counsel appearing for the State opposed the prayer and 2026:JHHC:3467 2 submits that the allegations are there of carrying the said diesel in the said vehicle. 5. Annexure-3 is the document, which suggests that in the cash memo issued of Ganpati Fuel Center, quantity of diesel is indicated as 225 liters. 6. In the attending facts and circumstances of this case, the petitioners are directed to surrender before the learned court within two weeks and the learned court shall release the petitioners on such terms and conditions and sureties, the learned court may deem fit and proper.
