(Oral) By means of present writ petition, petitioners have sought the indulgence of this Court for a direction to the respondents to grant benefit of selection pay/time scale to the petitioners by counting the services rendered by the petitioners before the institution came under grant-in-aid. 2. Brief facts of the case are that the petitioner no.1 is presently working as a Lecturer (Commerce) and petitioner no.2 is working as a Lecturer (Chemistry) in a grant-in-aid institution since 2016. Initially, the petitioners were appointed as an Assistant Teacher (L.T. Grade) on 23.06.1998 when the institution was not brought under grant-in-aid. The institution was brought under grant-in-aid in the year 2005. The petitioners claimed selection grade on the post of Assistant Teacher (L.T. Grade) by counting the service rendered by the petitioners prior to the institution was brought under grant-in-aid i.e. since 23.06.1998. The petitioners were so far denied selection grade by the respondents. 3. Learned counsel for the petitioners submits that the matter of the petitioners in the present writ petition is covered by the judgment rendered by the Coordinate Bench of this Court in WPSS No.1955 of UKHC010122272026 2026:UHC:5862 2 2015, Munendra Singh Rana and others Vs. State of Uttarakhand and others and other connected writ petitions decided on 27.03.2017, which was upheld by the Division Bench of this Court by the judgment and order dated 30.08.2018 passed in SPA No.279 of 2018, State vs. Harish Singh Bora and others, and batch. 4. This fact has also been admitted by the learned counsel for the State. 5. In this view of this matter, the present writ petition stands allowed in terms of the judgment and order passed by the Coordinate Bench of this Court in WPSS No.1955 of 2015, Munendra Singh Rana and others Vs. State of Uttarakhand and others and other connected petitions decided together on 27.03.2017 upheld by the Division Bench of this Court vide judgment and order dated 30.08.2018 passed in SPA No.279 of 2018, State vs. Harish Singh Bora and others and batch. 6. Accordingly, the respondents are directed to release selection time/pay scale, along with arrears, to the petitioners by counting their service rendered from the date of initial appointment in the institution namely Sanjay Public Inter College, Karbari Grant, Dehradun within a period of 10 weeks from today. The petitioners shall also be entitled to get interest @ 9% per annum. 7. It is made clear that if the arrears are not released within the aforesaid period, the petitioners shall be entitled to get interest @ 18% per annum. (Pankaj Purohit, J.) 15.07.2026 Ravi
