It is not disputed that the first respondent herein/plaintiff filed the above said suit for permanent injunction against the petitioner and others. Pending suit, the petitioner filed an application in I.A.No.5 of 2024 seeking rejection of plaint on 19.01.2024. A perusal of the e-courts status filed in the typed set of papers would indicate that counter of the contesting first respondent/ plaintiff has not been filed till date in the said application. 3.
