GP FOR HOME The Court made the following: 3 SUN, J W.P.No.21799 of 2026 THE HONOURABLE SMT JUSTICE SUNITHA GANDHAM WRIT PETITION No: 21799 OF 2026 This writ petition is filed to direct the respondent No.2 police to file final report/charge sheet in Crime No.443 of 2025 dated 17.10.2025 on the file of Tiruchanur Police Station, Tiruchanur, Tirupati District. 2. Learned Assistant Government Pleader for Home takes notice on behalf of respondent Nos.1 and 2. 3. Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home. 4. Learned counsel for the petitioner submitted that though the report dated 17.10.2025 of the petitioner is registered as a case in Crime No.443 of 2025 of the offences under Sections 118(1), 115(2), 351 (2) r/w 3(5) of BNS, the respondent No.2 has not showing inclination or interest to conduct investigation and file charge sheet and requested to issue direction to the respondent No.2 to complete investigation and file charge sheet. 5. Per contra, learned Assistant Government Pleader for Home filed written instructions received from Station House Officer of Tiruchanur Police Station, Tiruchanur, wherein, it is mentioned that he has been making sincere efforts to arrest the accused, he has been conducting investigation by examining witnesses, collecting oral and documentary evidence and taking all necessary steps as required under law and further, investigation is in progress 4 SUN, J W.P.No.21799 of 2026 and there has been no willful or deliberate inaction on his part. Further, respondent No.2 is fully conscious of their statutory obligations to complete the investigation expeditiously and immediately after completion of investigation, he would file necessary report in accordance with law. Learned Assistant Government Pleader also submitted that in case the respondent No.2 could not arrest the accused, soon after completion of investigation, he would file charge sheet or final report in accordance with law by showing the accused as absconding. 6. Learned counsel for the petitioner fairly conceded to dispose of this writ petition with that observation. 7. Recorded the submissions of learned Assistant Government Pleader. 8. In the result, this Writ Petition is disposed of. There shall be no order as to costs.
