Present Mr. N. Ibotombi, learned senior counsel assisted by Ms. Y. Jinita, learned counsel for the applicant, Mr. Y. Ashang, learned PP assisted by Mrs. RK. Emily, learned Dy. G.A. for State respondent and Mr. W. Darakishwor, learned Spl. PP for the CBI. [3]
By the present application, the applicant who is former Chief Minister and Member of Assembly approached this Court with a limited prayer of granting permission to leave India from 25.08.2026 to 10.10.2026 for study tour in foreign country organized by Manipur Legislative Assembly. [4]
It is submitted that vide common order dated 26.08.2019 in AB Nos. 9 of 2018, 10 of 2018, 11 of 2018 & 51 of 2018, this Court granted pre-arrest bail to all the applicants including the applicant herein who’s AB No. 11 of 2018 on certain grounds that they should not leave the country without prior permission from this Court. It is also pointed out that on similar occasion, vide order dated 04.11.2025 passed by this
Court in Crl.M.C. No. 42 of 2025, applicant was permitted to go to Indonesia, Singapore and Malaysia from 05.11.2025 to 28.11.2025 as part of foreign tour as provided by Manipur Legislative Assembly and on return, he was given one week’s time to report to Registrar General of this Court. Vide order dated 27.04.2026 issued by Secretary, Manipur Legislative Assembly, the name of the applicant is included at serial No. 1 along with four other MLAs. In the circumstances, it is submitted that an order similar to order dated 04.11.2025 be issued for the present case on the same condition. [5]
Mr. Y. Ashang, learned PP assisted by Mrs. RK. Emily, learned Dy. G.A. for the State respondent and Mr. W. Darakishwor, learned special PP for CBI, submit that this Court may pass appropriate
order in considering the earlier order dated 04.11.2025. [6]
Considering the submissions made at the bar, the application is allowed by directing the applicant to leave India w.e.f. 25.08.2026 to 10.10.2026 so as to enable him to visit Indonesia, Singapore and Malaysia as part of foreign tour organized by Manipur Legislative Assembly. However, on return to India, the applicant shall report in person before the Registrar General of this Court within one week on return to the State without fail.
