Petitioners were appointed as Forest Range Officer through State Public Service Commission. At the time of filing this writ petition, they were serving as Deputy Director and In-charge Sub Divisional Officer, respectively. Petitioners have sought the following relief:- “a. To issue order or direction in the nature of mandamus directing the respondents to implement the order dated 11.04.2018 (Annexure-2) passed by Respondent no. 1 and give the benefit of 3rd ACP to the petitioners the pay scale of Rs.37,400-67,000 with Grade pay Rs.8,900/- (as per the said order) from the date of entitlement by modifying the impugned order dated 29.6.2017 (Annexure-1). b. To issue order or direction directing the respondents to give arrears of difference in salary along with an interest of 14% p.a. from the date of accrual to the date of actual payment.” 4. In sum and substance, petitioners are staking claim for the pay scale, which is admissible to Conservator of Forests. They rely upon a Government order dated 11.04.2018 for claiming grade pay of `8,900/- as 3rd ACP. UKHC010142252018 2026:UHC:5953-DB 5. Learned State Counsel, however, submits that Government Order relied by petitioners was subsequently amended. Thus, he submits that Grade Pay of `8,900/- is not payable to the petitioners. 6. Since petitioners have sought a writ of mandamus staking claim for a particular grade pay, therefore, this Court thinks that ends of justice would be met, if petitioners are permitted to approach the competent authority for decision in the matter. 7. The writ petition is, accordingly, disposed of with liberty to petitioners to make representation to Secretary, Forest, Government of Uttarakhand. If petitioners make such representation within three weeks from today, decision thereupon shall be taken, as per law, within four months thereafter. (Pankaj Purohit, J.)
