Respondent had filed an application under Order 26 Rule 9 CPC for issuing a Commission for ascertaining the boundaries of the property in dispute. Said application was rejected by the Trial Court, vide order dated 16.9.2025, however in Revision, 2nd Additional District Judge, Kashipur set aside the order passed by the Trial Court and allowed the application filed respondent-defendant for issuance of Commission, vide order dated 26.5.2026. (3) Mr. Piyush Garg, learned Counsel for the petitioner, after arguing for a while, submits that petitioner is giving up challenge to the judgment rendered by the Revisional Court. (4) In view of the statement made by Mr. Piyush Garg, writ petition stands disposed of with observation that the Trial Court shall not be influenced by any observation made by the Revisional Court, while allowing the revision filed by respondent-defendant.
