1 | P a g e IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C). No.13955 of 2026 Bhagirathi Sa @ SHA …. Petitioner Represented by Mr. S.Dash, Advocate -Versus - State of Odisha and Ors …. Opposite Parties Represented by Mr. S.N.Pattnaik, AGA CORAM: JUSTICE SASHIKANTA MISHRA ORDER_ 06.05.2026 1. This matter is taken up through hybrid mode. 2. The grievance of the petitioner is that a sale deed executed on the basis of un-probated Will filed through online mode has not been registered despite several attempts. Since the office of the Tahasildar is not accepting the offline application for mutation, the petitioner has approached this Court. 3. Considering the submissions as above, this Court is of the view that though the application for mutation is to be submitted online yet there being apparently no mode available to upload un- probated Will in the online portal, the concerned authority shall accept such documents physically. 4. The writ application is therefore, disposed of leaving it open to the petitioner to apply for mutation by submitting application in the Order No. 01. 2 | P a g e online mode with liberty to submit the un-probated Will physically. If such application is made within fifteen days from today, the Tahasildar shall act upon the same and also accept the physical copy of registered documents to be produced by the petitioner and to proceed thereafter in accordance with law.
