JUSTICE SANJEEV KUMAR SHARMA ORDER 15.06.2026 Heard Mr. B.D. Konwar, learned Senior Counsel assisted by Mr. K. Kalita, learned counsel for the petitioner. Also heard the learned Additional Public Prosecutor. This is an application filed under Section 483 of BNSS, 2023 for grant of regular bail. The allegations in brief is that one Jugal Kalita of Dharapur, Azara, has lodged an FIR at Azara P.S. alleging inter-alia that his son Nirban Kalita works at Snowman Company, situated at Mirzapur, Azara. It is alleged that accused No.2 instigated the son of the Informant to record a video on the alleged incident that the accused No.1/petitioner who is also an employee of the said Company had entered into the Company's bathroom with a girl. It is further alleged that on the said issue, on 02.06.2026 at about 6-30 p.m., the FIR named accused persons along with the present petitioner and about 10 numbers of persons had asked the son of the Informant to Dharapur Majali and assaulted him with an intention to kill him. As a result of which Informant's son was sustained serious injuries on his person and taken to Garal Hospital, but the Doctor referred him to GMCH. Accordingly on the basis of allegations a case has been registered Page No.# 3/3 being Azara P.S. Case No.63/2026, Under Section 189(2)/109(1)/117(2) of B.N.S., 2023. The case diary as called for has been produced. I have perused the bail objection filed by the Investigating Officer as well as the medical documents available in the case diary, where from it appears that the victim did not sustain any serious injury although some to the eye witnesses have implicated the present petitioner. Having regard to the nature of the injuries sustained as well as the nature of the allegations, further detention of the petitioner may not be necessary, provided necessary conditions are imposed. Accordingly, the prayer for bail is allowed. The petitioner shall be released on bail on furnishing a bail bond of Rs. 50,000/- with 2 sureties of the like amount to the satisfaction of the concerned Trial Court. It is further provided that the petitioner upon release shall not attempt to contact the victim or his family members and shall not try to influence them or any other persons acquainted with the facts of the case in any manner.
