The Petitioner has approached this Court for grant of regular bail in connection with Bariyatu P.S.Case No. 10/2025, registered for the offence under Section 111(4) of B.N.S and 15(c),17(c),18(b),22,25,29 of N.D.P.S Act. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has no role in commission of the alleged offence. He further submits that other similarly situated co-accused person, Jageshwar Ganjhu, having same and similar allegation has already been granted bail by Co-ordinate Bench of this Court vide order dated 14.08.2025 in B.A. No. 4420 of 2025. He further submits that the petitioner is languishing in custody since 07.01.2026; as such, the petitioner may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court. 4. Learned A.P.P opposes the prayer for bail of the Petitioner. 5. Having regard to the facts of the case and looking to the allegation made against this petitioner, coupled with the fact that similarly situated co-accused person having same and similar allegation has already 2026:JHHC:7264 2 been granted bail by Co-ordinate Bench and also the fact that the petitioner is languishing in custody since 07.01.2026; I am inclined to enlarge the Petitioner on bail. Accordingly, the above-named Petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of Special Judge, N.D.P.S, Latehar, in connection with Bariyatu P.S.Case No. 10/2025. 6. It is made clear that the Petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this Petitioner, learned trial court shall be at liberty to cancel the bail of this Petitioner.
