Learned counsel for the petitioner submits that the petitioner is in custody since 27.09.2025 in connection with S.T. Case No. 12 of 2026 arising out of Mahuatand P.S. Case No. 35 of 2025, registered under Sections 103(1), 238 & 3(5) of Bharatiya Nyaya Sanhita, 2023, now pending in the court of learned Addl. Session Judge III, Bermo at Tenughat. 3. Learned counsel for the petitioner has further submitted that the petitioner has been wrongly made an accused in this case, though he is the husband of the victim and the victim was found dead in her matrimonial house. She submits that the parents of the victim had, in fact, thrown out their daughter and she was not happy in her matrimonial home because of such incident. 4. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that as per the First Information Report, immediately prior to the incident the daughter had rang up the informant- father that her husband had been assaulting her on that day and the independent witnesses have also supported the 2026:JHHC:12789 2 case that the victim had called her father and informed her father about the assault by her husband. 5. Considering the aforesaid facts and circumstances, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 6.
