This writ petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 The Hon’ble Court may kindly be pleased to issue a writ/order/direction in the nature of mandamus thereby directing the respondent authorities to consider and decide the case of petitioners for compassionate appointment in accordance with law, in the ends of justice. 10.2 Any other relief, which Hon’ble Court deems fit and proper be awarded in favour of the petitioner, including cost.” DEEPTI JHA Digitally signed by DEEPTI JHA 2 2. Learned counsel for the petitioners would submit that husband of the petitioner No.1 and father of the petitioner No.2 namely, Hom Singh Thakur was working on the post of Head Cashier “E” with the respondents, who died in harness on 25.04.2011. He further submits that the application dated 28.08.2014 (Annexure-P/4) made by the petitioner No.1 seeking compassionate appointment for his son, i.e., petitioner No.2. He would further submit that the said application is still pending consideration with the respondents and it has not been decided yet. Thus, he prays that this petition may be disposed of directing respondents to decided the same or the petitioner No.2 may be permitted to make a fresh application in continuation of the earlier application (Annexure-P/4). 3. Learned counsel for the respondents does not raised any objection with regard to the limited prayer made by the counsel for the petitioners. 4. In view of the above, the instant writ petition stands disposed of, in addition to the application (Annexure-P/4), petitioner No.2 is permitted to make a fresh application before the concerned respondents for consideration of the case for compassionate appointment within a period of 45 from the date of receipt of copy of this order. On receipt of such application, concerned respondents shall take a decision of the said application and also on the application (Annexure-P/4), if it is already been not taken, within a further period of 120 days. 5.
