It is contended by learned Counsel for petitioner that the controversy in this writ petition is finally settled by the Division Bench of this Court in Special Appeal No.245 of 2022 (Managing Director, Uttarakhand Transport Corporation v. Ashok Kr. Saxena) and batch, decided on 04.04.2024. It is further contended that the case of petitioner is squarely UKHC010123662026 2026:UHC:6012 covered by the judgment passed in aforesaid special appeal. 5. Learned Counsel appearing for respondent-Corporation also does not dispute this fact. 6.
