The petitioner, above-named, who is in custody since 02.07.2025 in connection with Nagar Untari (Garhwa) P.S. Case No. 63 of 2025 for the offence registered under Sections 25(1-b)a / 26/ 35 of the Arms Act has prayed for regular bail. It is submitted by the learned counsel on behalf of petitioner that no fire-arm or ammunition has been seized from him, therefore, the offence under the Arms Act will not made out. It is further submitted that his name has transpired on the basis of confessional statement of co-accused, Tausif Khan from whose confessional statement, arms and ammunition were recovered. Learned A.P.P. for the State has opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
