Petitioner has filled this petition seeking the following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to quash/set-aside the impugned transfer order dated 30.06.2025 (Annexure P-1) so far as it concerns the present petitioner.. 10.2 That, this Hon’ble Court may kindly be pleased to decide the representation of the petitioner dated 03.07.2025 within specific time period. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to post the petitioner on the place as desired by the petitioner keeping in view of the transfer policy, 2025. 10.4 Any other relief, which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner, in the interest of justice.” 2. Learned counsel for petitioner submits that petitioner is holding the post of Assistant Development Extension Officer and posted at Janpad Panchayat Mungeli, District Mungeli is transferred to the office of Assistant Development Extension Officer, Janpad Panchayat Pandariya, District – Kabirdham. He submits that immediately after issuance of transfer order, petitioner submitted representation before the Committee constituted under transfer policy on 03.07.2025 raising grounds that his wife is also posted as Assistant Development Extension Officer at Lormi and she is also taking treatment of IVF since last three year. Out of 10 sanctioned post of Assistant Development Extension Officer at Janpad Panchayat Lormi, only two officer/employee are working including petitioner. Therefore, after issuance of order of transfer, Chief Executive Officer, Janpad Panchayat Lormi wrote letter on 05.07.2023 to Zila Panchayat, 3 Mungeli for posting of Development Extension Officer. He contended that till date the representation submitted by petitioner has not been considered and decided. As per the policy of the State Government, husband and wife, who are government employee should be posted at once place. Therefore, direction be issued to the Committee to consider and take decision on the pending representation submitted by petitioner expeditiously and till then some interim protection may be granted in favour of petitioner. 3. Learned State counsel submits that order of transfer is on administrative ground. She contended that policy which is referred by petitioner cannot be held as statute and under that policy petitioner cannot claim as a matter of right to be posted at particular post, however, the grounds raised by petitioner is still pending consideration before the Committee and it will be considered and decided expeditiously in accordance with law. 4. On due consideration of the submission of learned counsel for parties and further considering that since June, 2025 petitioner was not relieved by the Chief Executive Officer, Janpad Panchayat Lormi under whom, petitioner is working and according to the submission of learned counsel for petitioner, he has been relieved on 12.01.2026 and considering that sanctioned post is still lying vacant at Janpad Panchayat, Lormi, the Committee has not taken any decision on the representation submitted by petitioner for about six months, writ petition at this stage is disposed of directing the Committee to consider and take decision on the representation submitted by petitioner in 4 accordance with expeditiously preferably within further period of three weeks from the date of receipt of this order. 5. Till the decision is taken by the Committee on the representation submitted by petitioner, order of transfer so far as it relates to petitioner shall remain stayed. 6. Learned counsel for petitioner is directed to serve the copy of the order passed by this Court to the Committee constituted under transfer policy within period of one week from today. 7.
