The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1589 of 2025 pending on the file of learned S.D.J.M., Nabarangpur, arising out of Maidalpur P.S. Case No.117 of 2025 for commission of offences punishable under Sections 319(2)/ 309(6)/ 3(5) BNS, 2023. 3. It is submitted by the learned counsel that the Petitioner does not have any criminal proclivity and in the meanwhile charge sheet has been submitted and since the co-accused has been released on bail, the Petitioner may be protected by pre-arrest bail. 4. It is further submitted by the learned counsel that the basis of implication is on account of the co- accused statement. p. 2 5. Learned counsel for the State opposes the prayer for pre-arrest bail, inter alia, on the ground that the charge sheet has been filed citing the Petitioner as an absconder. 6. Taking into account the nature of allegations and the manner of implication, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature. If it comes to the fore that the Petitioner has any such criminal antecedent, this order shall not be given effect to. 7.
